Following the decision by the Supreme Court
to allow same sex marriages all over the country, there have been quite a
number of colorful parades and celebrations. However, after all the fanfare,
it’s probably time to assess the ripple effects of the ruling.
There’s a joke that goes around with the
question: “Name one major reason that
causes divorce?” The answer serving as the punchline: “Marriage”. Hilarious as
it may be, there is undeniable truth to it. Now with official gay unions due to
increase, are we to expect official gay split-ups, too?
As of October last year, gay marriage has already
been allowed in Phoenix; however, state laws are still evolving with respect to
same-sex divorce, and there's no universal rule to it yet. It gets further
complicated if there are child custody issues to iron out. Which partner gets
custody since neither can lay a claim based on gender?
Marriage is always a beautiful thing, so it’s
always a sad day to see it over. You may be wondering how to go about it and if
you need an attorney.
Although laws in Phoenix allow for
self-representations at divorce hearings, same-sex annulments are an all new
legal territory. If you have come to the unfortunate decision to call it quits
with your partner, you will definitely do well to go through a lawyer. Just let
them handle it to protect your rights, and avoid unnecessary complications.
